Our most memorable positive moments are moments of joy, when we feel connected or feel proud. As president of MSSNY I am fortunate to experience such feelings during my visits to various county medical society meetings. I am inspired again and again by the leaders and influencers all around our great state.

Recently I met the presidents and immediate past presidents of several counties, including Queens, New York, Richmond, and Nassau. Congratulations to Drs. Keith LaScalea, Lawrence Melnikar, David Fishman and best of luck to Drs. Erick Eiting, Jagdish Gupta, and Joseph Cooke.

MSSNY leadership and I had a dialogue this week with presidents of the county societies, MSSNY committee chairs and our county executive directors about diversity, member engagement, and upcoming programs for physicians. We will have an ongoing discussion about diversity and inclusion. I encourage you to watch these short videos on implicit bias from UCLA.

This week, MSSNY was frustrated by the US Supreme Court’s decision striking down the New York gun law and condemned the Supreme Court’s decision overturning Roe. Also this week, MSSNY applauded the FDA’s ban on Juul e-cigarette products.

MSSNY Recoups Almost 6 Million Dollars in Insurance Company
Takeback on Behalf of MSSNY Member

On another note, we have very exciting news to share this week. We just received word that our Director of Physician Payment and Practice successfully recouped a $5,936,939.42 insurance takeback for a MSSNY member’s practice. Yes, almost 6 million dollars!

Please see the Physician Payment and Practice section further down in Pulse to read the letter the member wrote to us in its entirety, which explains the entire ordeal. In short, Heather Lopez, MSSNY’s Director of Physician Payment and Practice, stepped in on behalf of a MSSNY member and ultimately succeeded in bringing the insurance overpayment to a zero balance. “[Insurance company name omitted] went on to deny every claim submitted for five years and extrapolated their findings with the rationale that the operative reports were not signed and requested a total overpayment of $5,936,939.42. This would have essentially forced our orthopedic private practice to close,” writes the MSSNY member who requested that his name be withheld. “Not knowing where to begin, I reached out to MSSNY and was put in contact with Heather Lopez, the Director of Physician Payment & Practice for MSSNY. After explaining to her the situation, she immediately became a staunch advocate on my behalf. Throughout this process, I was comforted in the fact that as a member of MSSNY, I was well represented.”

Universal Health Care Could Have Saved More Than 330,000 U.S. Lives During COVID
Americans spend more on health care than people in any other nation. Yet, the American medical insurance system causes many preventable deaths and unnecessary costs. COVID-19 has only exacerbated this already dire public health issue, as evidenced by the U.S.’s elevated mortality compared with other high-income countries. According to a new study published by Proceedings of the National Academy of Sciences, from the pandemic’s beginning until mid-March 2022, universal health care could have saved more than 338,000 lives from COVID-19 alone.

The study compared the mortality risks of insured and uninsured Americans and the risk of death from COVID-19 and all other causes of death. The researchers compiled population characteristics of all uninsured Americans during the pandemic, considering age-specific life expectancy and the elevation in mortality associated with a lack of insurance. They calculated that 131,438 deaths could have been preventable from COVID in 2020 alone. And more than 200,000 additional deaths from COVID-19 could have been averted since then, bringing the total through March 12, 2022, to more than 338,000.

Craig L. Katz, MD. Receives Excellence in Emergency Preparedness and Disaster/Terrorism Response Award
Congratulations to Craig L. Katz, MD, who received MSSNY’s David B. L. Meza, III, MD Award for Excellence in Emergency Preparedness and Disaster/Terrorism Response. Dr. Arthur Cooper presented the award to Dr. Katz during the MSSNY Council meeting on June 23.

In presenting the award, Dr. Cooper noted that Dr. Katz’s commitment to educating fellow physicians about the importance of their role during a public health crisis has been intricate during the Covid-19 epidemic. He developed programming on Psychological First Aid Following Disasters, Mental Health, and the Impact of Disasters, the Psychological and Epidemiological Aspects of Vaccine and Stress and Distress. During that time, Dr Katz was also assisting MSSNY in training peer supporters for MSSNY’s Peer-to-Peer program.

Dr. Meza, in whose honor this award is named, served the medical community in many capacities for much of his career and was a founding member of the MSSNY emergency preparedness committee.  In line with Dr. Meza’s beliefs in educating fellow physicians, Dr. Katz has developed most of MSSNY’s educational programming on psychological trauma due to mass casualty events, such as bioterrorism.

Dr. Katz is a Clinical Professor of Psychiatry, Medical Education, System Design and Global Health at the Icahn School of Medicine at Mount Sinai in New York City. He is the founding director of Mount Sinai’s Program in Global Mental Health and serves as the vice-chair of MSSNY’s Committee on Emergency Preparedness and Disaster/Terrorism Response.


Climate Change, Fossil-Fuel Pollution, and Children’s Health
The combustion of fossil fuels causes both air pollution and greenhouse-gas emissions, accelerating climate change. Given the frequent co-occurrence of various fossil-fuel exposures, their interactions and cumulative environmental impacts are a growing concern. Children are at risk, but the most significant burden falls on socially and economically disadvantaged people. According to a new study published by the New England Journal of Medicine, the fetus, infant, and child are especially vulnerable to exposure to air pollution and climate change, which are already taking a significant toll on children’s physical and mental health. Protection of children’s health requires that health professionals understand the multiple harms to children from climate change and air pollution and use available strategies to reduce these harms.

Designing Hospitals that Promote Staff Wellbeing
During Covid, hospitals have seen increased employee turnover rates, which is costly to morale and the bottom line. According to Becker’s Hospital Review, in 2020, the turnover rate for registered nurses increased 2.8 percentage points to 18.7% industry-wide. Each percentage change translates to approximately $270,000 lost or saved per hospital. These numbers have prompted hospitals to rethink their approach to the physical environment and incorporate research-based design strategies that improve the well-being of both patients and the staff guiding their recovery. Behavioral health challenges existed before the pandemic and will persist after it’s over. Only by creating spaces and implementing solutions that simultaneously promote staff well-being and patient healing can they effectively retain and recruit staff and reduce the financial impact of burnout and turnover. Designing buildings to enhance employees’ well-being will help keep them satisfied and productive.

An Analysis of Plastic Surgeons’ Social Media Use and Perceptions
Social media allows the interactions among people in which they create, share, and exchange information and ideas in virtual communities and networks. According to the Aesthetic Surgery Journal, the most common reason for incorporating social media into one’s practice has been marketing or branding; most surgeons believed it was inevitable that social media would enter the professional sphere. Results from the ASJ study support this fact because the overwhelming majority of respondents cited “creating an online presence” and “practice expansion” as reasons for maintaining professional social media accounts.

The enthusiasm surrounding professional social media use is not universal among all surgeons. For instance, older surgeons are more likely to believe social media worsens the image of the field. Despite its potential as an effective communication and marketing tool, the openness and familiarity of this platform may also leave users and their reputations vulnerable to abuse or damage.

MSSNY Submits Recommendations to Department of Financial Services (DFS) on Implementation of New Law Regulating Pharmacy Benefit Managers (PBMs)
MSSNY recently submitted detailed recommendations for implementation of the new law that was supported by MSSNY that will require greater financial transparency from pharmacy benefit managers (PBMs) and enhance state oversight over PBMs. The law will require PBMs be licensed by DFS, that they adhere to standards established by the agency and disclose all revenue streams and terms and conditions that are placed on their networks of pharmacies. MSSNY has long supported greater oversight and regulation of PBMs as a vital step to addressing restrictive formularies and excessive prior authorization requirements that interfere with patients’ ability to access the medications needed to treat their condition.

Highlights of MSSNY’s recommendations included requesting DFS to adopt rules regarding PBMs use of prior authorization and step therapy protocols to provide full transparency through mandated reporting and to the extent their authority permits, limit PBM intrusion into the physician-patient relationship. MSSNY also expressed its support for the new law’s requirements that PBMs be licensed by DFS and that they adhere to standards established by the Department, as well as disclosure of all revenue streams and terms and conditions that they place on their networks of pharmacies.

MSSNY comments also stressed that DFS rules should specifically define the fiduciary obligations owed to vendors, including health plans, and how that obligation ultimately relates to the patients covered by insurers who secure the prescription medications that the PBM controls access to.

MSSNY requested that DFS require PBMs to report to both health plans and the public a number of key data points as it relates to interactions by patients and their health care providers with PBMs, such as: prior authorization and step therapy rules and policies; The number of prior authorization and step therapy reviews conducted by the PBM identified by drug and cost amount as well as aggregate; The number of prior authorization and step therapy denials vs approvals conducted by the PBM identified by drug and cost amount as well as aggregate; and the time spent by physicians and consumers dealing with prior authorization and step therapy requirements, including but not limited to phone wait times and number of calls, broken down by physicians and consumers and drug.

MSSNY looks forward to continued dialogue with DFS staff in the coming months, to providing additional specific input that ensures patients have affordable access to the most effective treatments and will update members as new policies are established.


Physicians Urged to Request Governor Hochul to Veto De-Stabilizing Expansion of Wrongful Death Awards
All physicians are urged to contact Governor Hochul Reject Expansion of Liability (p2a.co) to request that she veto legislation (S.74-A, Hoylman/A.6770, Weinstein) that could greatly increase physician medical liability premiums by significantly expanding the types of damages awardable in a wrongful death action. The bill was passed over the strenuous opposition of numerous and varied groups, including MSSNY, specialty societies, hospital associations, FQHCs, the Business Council of New York, medical liability and property & casualty insurers, The New York State Association of Counties, and the New York Conference of Mayors.

Specifically, the legislation would increase the already expansive damages awardable in such actions to include compensation for grief or anguish, the loss of love and companionship, loss of services and support, and the loss of nurture and guidance. One actuarial study has suggested that this bill has the potential to increase New York’s already outrageously high medical liability premiums by over 30%.

MSSNY has argued that legislation like this should only be considered in the context of a comprehensive effort to address New York’s excessive liability costs. While some advocates claim that over 40 states have laws that permit recoveries similar to what is proposed in this legislation, they do not mention that most of these other states have adopted provisions to contain excessive medical liability insurance costs, including limits on damages. New York has no such law, which is why our medical liability insurance and payout costs far exceed every other state in the country. This is one of the major reasons why New York regularly receives the dubious distinction of being one of the worst states in the country to be a doctor (Best & Worst States for Doctors (wallethub.com)).

An article in Spectrum News/State of Politics entitled “New York Health Advocates Cheer FDA’s Juul Move” notes that New York health advocates and state lawmakers who have sought to limit the spread of vaping products in the state cheered the federal Food and Drug Administration’s decision on Thursday to pull Juul products off the shelves.

“Today’s decision is another step in protecting our nation’s youth from using e-cigarettes,” said Parag Mehta, the president of the Medical Society of the State of New York. “It will play a significant role in preventing tobacco companies from using e-cigarette products to addict yet another generation of children to nicotine. As physicians, we know the importance of developing healthy habits in childhood. Today’s decision is an important step in helping our children achieve wellness throughout their lives.”


Dr. Sellers Speaks to Capital Tonight About COVID Vaccines for Young Children
MSSNY Immediate Past President Dr. Joseph Sellers spoke to Spectrum News Albany’s Capital Tonight this week about the COVID-19 vaccine for children under 5, recommending that parents that have concerns about the vaccine should discuss it with their pediatrician. “My message is: Talk to your doctor,” he said. “Talk to the person who you trust to take care of your children, the person who is there when your kids are sick, the person who is there to help your children have the best growth development and the healthiest and happiest life.”

MSSNY Recoups Almost 6 Million Dollars in Insurance Company Takeback on Behalf of MSSNY Member
Following is a letter written by a MSSNY member who was informed this week that Heather Lopez’s work on his practice’s behalf resulted in the cancellation of an almost 6-million-dollar insurance company takeback:

“Dear MSSNY:

I am writing this letter as a letter of appreciation to the Medical Society of the State of New York. In October 2021, I received a letter of correspondence from [Insurance company name omitted]. It stated: ‘We recently completed a post payment claim review for some of your patients who are [Insurance company name omitted] members, for services provided on 9/29/2015 – 12/22/2020. This review was conducted by [Insurance company name omitted] to verify that you followed all established coding and billing requirements and to help ensure you received correct payment for the services provided.’ [Insurance company name omitted] went on to deny every claim submitted for five years and extrapolated their findings with the rationale that the operative reports were not signed and requested a total overpayment of $5,936,939.42. This would have essentially forced our orthopedic private practice to close.

Not knowing where to begin, I reached out to MSSNY and was put in contact with Heather Lopez, the Director of Physician Payment & Practice for MSSNY. After explaining to her the situation, she immediately became a staunch advocate on my behalf. After sending [Insurance company name omitted] a letter of appeal, they sent me back a final overpayment decision in the amount of $4,549,601.34. Throughout this journey, Ms. Lopez kept on top of the situation, often emailing [Insurance company name omitted] requesting updates. I was then contacted by the claim specialist who, after bringing the matter to her ‘supervisors,’ told me we can settle this by paying $156,000. What amazed me was that this was not a foreign email scam, but rather a sanctioned [Insurance company name omitted] ‘investigation’ under the guise of compliance and proper coding.

Throughout this process, I was comforted in the fact that as a member of MSSNY, I was well represented. Ms. Lopez reviewed the operative reports and corresponding CPT codes, even going so far as putting the codes through software programs in order to determine that they were not bundled as [Insurance company name omitted] had alleged. The company then requested a negotiated settlement conference, which they promptly canceled when they found out that MSSNY’s Director of Physician Payment & Practice would be participating in the call. When the call finally did take place, Ms. Lopez actively participated and voiced her concerns. We went through each allegation, disproving [Insurance company name omitted]’s arbitrary determinations. They finally agreed to dismiss the case with the take back request reduced to $0. I have been in practice for 23 years. Throughout this time I never would’ve thought that my membership in MSSNY would be as valuable to me as it has proved to be.”


Cigna Modifier 25 No Longer Taking Effect August 13, 2022.
MSSNY stands ready to discuss further with Cigna ways to address inappropriate use of the modifier 25. MSSNY has heard from several other physician organizations concerned with Cigna’s modifier -25 policy, many of which have either contacted Cigna directly or are in the process of highlighting the concerns and requesting the policy be rescinded.

Accordingly, MSSNY urges Cigna to rescind the policy before it becomes effective. We believe a more collaborative approach to identifying alternative methodologies for cost containment, including provider education on proper coding practices that do not bluntly penalize physicians using the modifier appropriately, will prove more effective and less costly in the long term. With the shift to value-based care, this is a time where plans and physicians should be identifying ways to work together. MSSNY welcomes that opportunity.

AMA Webinar on the Foundations of Racism in Medicine
On June 29th, from 7 – 8:30 pm ET, the American Medical Association will host a 90-minute webinar on the foundations of racism in medicine. Dr. Emily Cleveland Manchanda, the Director for Social Justice Education and Implementation at the AMA, will give a 60-minute didactic presentation followed by 30-minutes of Q&A. The presentation will include descriptions of:

  1. Basic terminology around race and racism
  2. Manifestations of racism in medicine at interpersonal, institutional, and systemic levels
  3. Recommendations for additional reading and learning for physicians to continue their health equity education

The webinar will be uploaded to AMA’s EdHub, and 1.0 CME credit will be offered.

Responsibilities includes but not limited to conducting nutritional assessment, developing and implementing patient specific care plans and recommending nutrition care plans to patients as well as recommending therapeutic diet modifications and /or supplemental feedings to patients. Must have a degree in Nutrition or Dietetics, should be RD license, Registration by the Commission on Registration (CDR) as a Registered Dietitian (RD) in New York State plus specialized certifications as needed.
